What is a work visa or regulated permit to work?

It is the document granted by the immigration authority, in Mexico the National Migration Institute, gives a foreigner so that he can carry out some remunerated activity within the country, that is, he can work legally in the country.

This permit is different from the others that we could obtain to be regulated in the country, such as Permanent Residence, Temporary Residence among others.

How is this process done?

First of all, the person in charge of carrying out the entire process and procedures of this application is the employer, that is, the company, natural person or legal representative of this, who you are hiring a foreigner.

Starting with a Mexican natural person or company, making a Letter of Invitation to work within the company, it must have certain requirements, of which I mention some: must be on letterhead, it must specify the work and the time in which it is going to be within the company, as well as the income that the person who is being hired will receive. It is necessary for the company to be registered with the INM, in order to carry out these activities.

IMPORTANT: Clarifying that the employee could not have previously made any request to receive any type of residence within the country.

After having delivered all the documentation, you will have to schedule a consular interview, which will take place within the consulates or embassies of Mexico, in the foreign country. If you are already in Mexico, it is not possible to carry out such an interview, so you must travel to the foreign country again.

Once the interview is done, and the application is accepted, you will be able to enter the country with your work permit, which can be interpreted as a Temporary Residence within Mexico, with permission to carry out paid activities for up to one year.

What happens if I am in Mexico and do paid activities without permission?

It may be that by having a temporary, permanent or tourist residence, and carrying out paid activities, when carrying out this type of activity, the law is being violated, so if The immigration authority detects that these activities are being carried out illegally, it can initiate an Administrative Procedure, of which we could be made available to it, you could be entitled to a fine ranging from twenty to one hundred days of Unit of Measurement of Update and in case of being classified as a serious case, they could be deported.
