Child support when one parent is in Mexico and the other isn't.
I handle the court case in Mexico and the international procedure that goes with it, for parents on either side of the border.
What's going on
A child support order is only as good as your ability to enforce it. When the parent who pays lives in another country, a Mexican court order on its own doesn't reach them.
Mexico has agreements with a number of countries for exactly this. The case is decided in a Mexican court and then processed through Mexico's Ministry of Foreign Affairs (SRE) so it has effect abroad.
Handle the child support case in a Mexican family court.
- Handle the SRE procedure so the order can be acted on in the other country.
- Increase, reduce or cancel an existing order when circumstances have changed.
- Negotiate where that's possible. Support and visitation can often be agreed without a full trial.
- Act for you by power of attorney if you're outside Mexico.
How long it takes
On average, eight months to a year and a half.
The consultation: US$100 · 45 minutes.
The case: a fee for the court case and a fee for the SRE procedure, both given to you in writing before any work starts.
Frequently asked questions
The other parent lives in the United States or Canada. Can I still get support?
Yes. I've handled the SRE procedure with both countries.
I'm the parent abroad and I want to set support up properly.
Yes, I take those cases too. Doing it through the court protects you as well: what you pay is on the record.
The amount no longer makes sense. Can it be changed?
Yes. I handle increases, reductions and cancellations of child support.
Do I need to travel to Mexico?
Not necessarily. You can attend by video call or be represented through a power of attorney.
