Fideicomiso or Mexican company? It depends on what you plan to do with the property.
I review the documents and tell you which structure fits your plans, before you sign something that's expensive to undo.
What's going on
If the property is within 50 km of the coast or 100 km of the border, a foreigner can't hold it directly. You need either a fideicomiso or a Mexican company.
Most buyers are simply told «you need a fideicomiso» by the agent and never hear about the alternative. For a house you'll live in, that may be fine. For anything with a business plan behind it, it deserves a second look.
Why your plans matter
A client bought two houses side by side to turn them into a hotel. One went into a fideicomiso, the other into a Mexican company. Buying both through the company would have been better: for taxes, for the business activity itself, and to be able to merge the two lots.
Nobody had asked him what he planned to do with them.
How I can help
- Ask what you plan to do with the property — live in it, rent it, run a business, buy more — because that decides the answer.
- Review the fideicomiso or company documents before you sign.
- Tell you which structure fits, and what each one means for taxes and for what you're allowed to do with the property.
- I don't set up the fideicomiso myself. I go through the process with you and help you obtain and validate the documents it requires.

Only within 50 km of the coast or 100 km of the border, and even there a Mexican company is the alternative.
Which is better?
It depends on your plans. If you intend to buy more than one property or run a business, the company deserves serious consideration.
